NSW planning changes: a quick, easy renewal process

One of the reasons for housing continuity problems in NSW is the cumbersome planning system which can lead to long waits for planning permission. A slow-based process slows down the build speed. It’s no surprise that housing supply is struggling to keep up with demand.

On 17 September, the NSW state government announced it was introducing “Global” legislation to reform planning laws across the country, the biggest changes in 50 years.

At the time of writing, the legislation has passed the NSW lower house and is now being challenged by the upper house.

As well as encouraging the construction of new homes, there are also some important changes that should improve the process of renovating their home.

The full coverage of the new law makes for easier, faster and more uniform adoption in different local councils.

Development Coordinating Authorities

At the heart of these changes is a new body to be called the Development Coordinates Authority.

This will act as a “single front door” to advise on development requests and planning proposals on behalf of all NSS government agencies.

It will also coordinate responses from all these government agencies. In fact, they will do a run around that has, until now, been done by the home owner or whoever does it for them.

Expanding the way to keep up with development

Another important reform change is the increase in compliance and development regulations.

The accompanying development already provides a fast-track approval process for direct rehabilitation work that meets pre-determination standards.

With new changes, minor variations in the accompanying development plan must be approved within 10 days, or the variations will be deemed automatically approved.

In the past, the delay in the approval of these small changes can stay with the local council for a long time, completely reducing the idea of ​​a quick option.

Standard standing in councils

The reforms aim to introduce consistent, state-wide consent conditions for general development. This gives greater assurance to the bakers and the preparations.

What’s next?

The NSW Environmental Design and Assessment Amendment Bill for 2025 was passed with amendments in the NSW legislative assembly on 16 October, and debate began in the legislative council on 21 October.

As might be expected, there was strong debate about the changes, with some proposed amendments. So the debate continues and is set to resume on November 11.
